UAH 50 million was refunded in investigation of misappropriation of the National Guard

The former Member of Parliament of Ukraine (MP), involved in misappropriation of the National Guard, refunded UAH 50 million to the state budget from the total amount of losses of UAH 81.64 million. In addition, the suspects' property was seized for more than 300 million. NABU and SAPO proved in court the facts of violations by a suspect of the obligations imposed by the court. The half of the bail in the amount of UAH 30 million paid by him was recovered to the State.

The Former MP (beneficial owner of the LLC Ukrbud Development) and eight persons are suspected of misappropriation of the NGU property in amount of UAH 81.64 million.

The investigation revealed that in 2000s, the Internal Troops of Ukraine (merged with National Guard of Ukraine) and the real estate developer signed an agreement according to which a residential complex with built-in parking and non-residential premises would be constructed on the territory of the former military unit. In exchange for a land plot of about 1 hectare in Kyiv city center, the National Guard was offered 50 apartments and 30 parking lots in the residential complex.

However later, in 2016-2017, the parties signed additional agreements, according to which the National Guard gave up apartments and parking lots in Pecherskyi district in exchange for 65 apartments in a residential complex of the same real estate developer in Kyiv outskirts. Expertize carried out within the framework of the pre-trial investigation established that the cost of these apartments is 81 635 448 UAH less than the first one to be received by the National Guard according to initial agreement.

The investigation is completed. Since May 2020, the suspects and their defense had been granted with access to the materials of the investigation.

On December 1, 2020, NABU and SAPO gave a notice of suspicion to the Former MP. He is suspected of giving an improper advantage for issuing an unreliable forensic expert's report. His actions are qualified under Part 3 Article 369 of the Criminal Code of Ukraine.

The day before, on November 30, 2020, the Deputy Director of the State Scientific Research Forensic Center of the Ministry of Internal Affairs of Ukraine was given a notice of suspicion of receiving an improper advantage. His actions are qualified under Part 3 Article 368 of the Criminal Code of Ukraine.

NABU Detectives agreed with the SAPO prosecutors the notice of suspicion for ex-official of the “UkrBud” company (state-owned). He is an official who holds a particularly responsible position now. However, NABU and SAPO were unable to carry out the planned investigative and procedural actions in time, due to the Prosecutor General's decision to change the group of prosecutors.

According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
