On September 22, 2020, the official of the Kharkiv District Administrative Court, exposed on the giving an improper advantage, received a notice of suspicion of committing a crime under Part 3 of Article 369 of the Criminal Code of Ukraine (“Proposal, promise or provision of improper advantage to an official”).
The SAPO Prosecutors on behalf of the Acting Prosecutor General gave a notice of suspicion to the official.
The investigation revealed that the official had pressured one of the judges of the Kharkiv District Administrative Court to rule decision in favour of a commercial company.
On September 21, 2020, before the relevant court hearing started, the NABU Detectives jointly with the SSU and SAPO exposed the Kharkiv DSA official at the time of the transfer of the improper advantage.
According to Part 1 Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of a crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
