Chernihiv Oblast prosecutor's office sent an indictment against deputy of one of the rayon councils to the Court on the fact of receiving illegal benefit (H. 3 tbsp. 368 of the Criminal Code of Ukraine).
According to the investigation, the deputy, who served as head of the structural subdivision of the Settlement Council, received from the entrepreneur the illegal benefit in the amount of 27 thousand UAH. For the "reward", the principal unit promised not to commit actions to enforce the penalties for improper fulfillment of the conditions of the contract. The funds were transferred to the business entity as a charitable aid to the account of which the member's details were provided.
Sanction article provides imprisonment for a term of 5 to 10 years with deprivation of the right to hugging certain posts or to engage in certain activities for up to 3 years, with confiscation of of property.
Notation: In accordance with art. 62 The Constitution of Ukraine shall be deemed innocent in the committing crime and shall not be subjected to criminal punishment until his or her guilt is proved in lawful order and established by the guilty verdict of the court.
